Kidz Therapy Terms and Conditions

This page outlines the terms and conditions that govern your use of our services, programs, and website. We believe in transparency and trust, so we've made this information clear and easy to understand. By engaging with Kidz Therapy—whether you're enrolling in a course, accessing resources, or communicating with our team—you agree to the terms set out below.

Scope and parties

These Terms of Trade apply to all services supplied by Kidz Therapy Limited (trading as Kidz Therapy) to the client named on the intake form or booking confirmation. Kidz Therapy is a New Zealand limited company offering child and family therapy services including art therapy, psychotherapy,  psychological therapy, educational psychology assessments, speech and language therapy, occupational therapy, children’s courses, and related services. By booking or attending a session, the client accepts these terms.

Services and appointments

Service description

Services are those agreed in the assessment, referral, intake form, or booking confirmation and may include assessments, therapy sessions, reports, consultations, courses, home visits, and telehealth sessions.


Scope changes

Any change to scope, additional sessions, or extra report time will be quoted and invoiced separately.

Fees and Payment

Fee schedule

Fees are set out on our current fee list and on booking confirmations.

Travel costs are incurred for any consultant or specialist services that take place at locations other than Kidz Therapy centre. These are in line with government rates.

Fees are subject to change.


GST

All fees are GST exclusive where applicable; GST will be added to invoices when required by law.


Invoices

Invoices are issued after or as otherwise specified for services provided. Payment is due on receipt or within the credit terms stated on the invoice.


Accepted payment methods

Bank transfer, credit/debit card, or other methods published on our website or advised by our administration team.


Late payment

Overdue accounts may incur interest and recovery costs and may result in suspension or cancellation of services until the account is brought up to date.


Insurance and funding

Clients are responsible for claiming any reimbursements from insurers or third-party funders. Kidz Therapy can provide receipts but do not accept responsibility for reimbursement outcomes.


Booking, cancellation and no shows

Bookings

Appointments are confirmed on payment of any required deposit or by agreement in writing.


Cancellation by client

Cancellations must be submitted in writing to info@kidztherapy.co.nz. If your child is scheduled for an educational psychology assessment, we require at least 5 working days’ notice.


If the client is scheduled for therapy and cancels with less 2 working days’ notice, a cancellation fee will be charged.

  • Cancellations of less than 2 working days prior to your appointment time will incur an automatic invoice of $115.
  • Cancellations of less than 24 hours will be charged at the full session fee.
  • For group courses, and workshops, different notice periods a non-refundable administration fee of $75. This fee covers processing, materials preparation, and communication costs, and is separate from the course tuition. The administration fee will be deducted from your course fees.


To secure an appointment for a neurodevelopmental assessment, a non-refundable deposit of $500 is required at the time of booking. This deposit confirms your commitment and allows us to allocate the necessary time and resources for your assessment. If you need to cancel or reschedule your appointment, we require a minimum of 5 business days’ notice.


In the event of a family emergency or illness, the decision to waive a cancellation fee is at the practice manager’s discretion. Medical certificates may be required in some cases.

Kidz Therapy reserves the right to update this fee with prior notice provided on our website or during the registration process.


No shows

Failure to attend a scheduled appointment without prior notice will attract the full session fee.


Rescheduling

We will make reasonable efforts to reschedule appointments if given appropriate notice. Repeated cancellations or rescheduling may require payment in advance or termination of scheduling privileges.


Cancellation by Kidz Therapy

We may cancel or reschedule for practitioner unavailability, illness, adverse weather, or other operational reasons. We will endeavour to provide as much notice as practical and will offer an alternative time or refund for cancelled sessions.

If you miss three scheduled appointments in a three-month period without 48 hours’ notice, the therapeutic relationship may cease. Your child of course can return to therapy, but you may be placed on a waiting list if your therapist does not have any openings. This is standard practice with private practice offices.

Telehealth and remote services

Consent

By agreeing to telehealth, the client consents to receiving services by phone or video and accepts the limitations of remote delivery.


Technical requirements

Clients must provide a safe, private space and required device, internet access, and compatible software. Kidz Therapy is not liable for interruptions caused by technology failures outside our control.


Confidentiality in telehealth

Clients must ensure privacy on their end; Kidz Therapy will use secure platforms and reasonable safeguards.

Confidentiality and privacy

Client information

We collect and hold personal information necessary to provide services. We handle information in accordance with privacy law and our privacy policy.


Consent to share information

We will not disclose confidential information except with the client’s prior consent or where permitted or required by law, including safety obligations. Consent to share with schools, funders, or other professionals will be obtained in writing where possible.


Records and retention

Clinical records are held securely for a period consistent with professional guidelines and legal requirements. Clients may request access to their records; requests may be subject to verification, reasonable copying charges, and redaction where disclosure would adversely affect a third party or the therapeutic relationship.

Client responsibilities

Attendance and engagement

Clients and caregivers are expected to attend scheduled sessions, engage honestly, complete agreed tasks between sessions, and cooperate with recommended strategies.


Information accuracy

Clients must provide accurate, complete information relevant to assessment and treatment. Failure to disclose material information may affect outcomes.


Health and safety

Clients must notify Kidz Therapy of any communicable illness or safety concerns prior to attendance.

Consent for children and decision makers

Parental and/or caregiver consent

For clients under the age of 16, consent must be provided by both parents or lawful guardian unless otherwise permitted by law. Where both parents hold parental responsibility, Kidz Therapy will seek direction about who will be the primary contact for appointments and disclosures.

Reports, assessments, and intellectual property

Reports

Assessments and written reports are prepared for the client and named referrers. Additional copies or copies released to third parties will require client consent and may incur an administration fee.


Use of reports

Reports are for the purpose agreed; using reports for other purposes (e.g., legal proceedings) must be discussed and may require additional scope, consent, or fees.


Intellectual property

Materials created by Kidz Therapy, including assessment templates, program manuals, and resources, remain our intellectual property.

Complaints and disputes

Complaints process

Raise concerns with the practitioner or administration promptly. If unresolved, escalate to management for review. We will acknowledge complaints, investigate, and respond in a timely manner.


External recourse

If dissatisfied with our response, clients may refer complaints to professional regulatory bodies or the appropriate external dispute resolution service.

Liability and limitation of liability

Standard of care

Kidz Therapy will provide services with reasonable care and skill in accordance with professional standards.


Limitation

Except to the extent prohibited by law, Kidz Therapy’s liability for any claim arising from services is limited to direct losses and capped at the total fees paid by the client for the specific service that gave rise to the claim. We are not liable for indirect, consequential, or punitive damages.


Kidz Therapy is committed to providing high-quality support for children and families within the scope of our expertise. However, please note that we are unable to provide assistance in the following areas:

  • Immigration Applications: We do not provide reports or assessments intended to support immigration or visa applications.
  • Legal Proceedings: We do not offer medico-legal reports or documentation intended for use in legal matters, including but not limited to custody disputes, court proceedings, or legal claims.
  • Parenting Orders and Custodial Disputes: We are unable to work with families who are currently involved in, or are likely to become involved in, Family Court proceedings related to parenting orders or custody arrangements.
  • Severe Mental Health Concerns: Our services are not suitable for individuals experiencing severe mental health issues that require specialist or crisis-level intervention. In such cases, we recommend seeking support from appropriate mental health services or emergency care providers.

Consumer Guarantees Act and Fair Trading Act

Nothing in these terms seeks to exclude or limit rights that cannot be excluded by applicable consumer protection legislation.


Termination

The closure session is integral to the therapy. We look at what has been accomplished, revisit the initial goals and how we are in relation to those goals, it helps everyone to see the progress and the positive changes that have been made.

Closure is especially important for the mental health of our clients. The door is always open for a potential resumption of therapy if required.


By client

Clients may choose to discontinue services at any time. However, we kindly request 2-weeks written notice prior to termination. This notice period allows us to provide appropriate closure for the child and facilitate a feedback conversation with the parent or caregiver. Any outstanding fees for services already delivered remain payable and must be settled in full.


By Kidz Therapy

We may terminate or suspend services where the client repeatedly fails to pay, breaches these terms, poses safety concerns, or where continuing treatment is clinically inappropriate. Where possible we will provide notice and referrals.

Emergencies and safety

Not an emergency service

Kidz Therapy is not an emergency or crisis service. In emergencies, contact emergency services or local crisis lines.


Risk management

If a practitioner has reasonable grounds to believe a client is at immediate risk of harm to self or others, we will take appropriate action which may include contacting emergency services or notifying relevant authorities without client consent.

Governing law and amendments

Law

These terms are governed by New Zealand law, and any dispute will be dealt with in New Zealand courts.


Changes to terms

We may update these Terms of Trade from time to time. The current version will be published on our website and provided on request. Continued use of services after notification constitutes acceptance of the updated terms.
